Vestal Assault/Attempted Robbery - February 8, 1998
On Sunday, February 8, 1998, at approximately 10:30 PM, a lone Asian male approached the rear door of the Olive Garden Restaurant, 1112 Vestal Parkway, Vestal, New York. The restaurant had closed at 10:00 PM and the remaining employees were cleaning the premises before leaving. The Asian male attempted to gain entry into the restaurant by asking for an employee. The Manager refused that entry and the Asian male left.

At 11:00 PM, the Manager and two employees were all that remained at the restaurant. The two employees left the building, leaving the Manager alone inside. As the two employees walked from the front door to the east parking lot they were approached by three men wearing masks who exited a car in the lot. A fourth man remained behind the steering wheel of the car. The two employees were separated by the masked men. One employee was taken to the rear door of the restaurant while the other employee was told to get into their car. The employee that was told to get into the car attempted to run towards the Parkway. One or two of the assailants began shooting at the employee, firing at least four times and striking him. The three assailants returned to their car, joining the fourth already in the car, and fled the scene.

Evidence processed at the scene included a number of 40 caliber casings. The firing pin and breech marks are consistent with firearms manufactured by both Glock and the Smith & Wesson Sigma series.
