Scott W. VanBergen

On July 3, 1991, Scott W. VanBergen was convicted of Rape in the Third Degree in Rensselaer County, New York  As a result, on August 6, 1991, VanBergen began a State Prison sentence of from 4 ½ to 9 years for that and other convictions.

On December 23, 1996, with the enactment of Megan’s Law, VanBergen became a Registered Sex Offender as a result of the Rape in the Third Degree conviction. Because of that same law, no more information can be given out regarding VanBergen’s Registered Sex Offender status and the rape charge.

On May 25, 2004, VanBergen was discharged from the New York State Correctional facility in Elmira, New York, after serving a sentence for conviction of Criminal Possession of Stolen Property in the Third Degree. As required in Megan’s Law, a Registered Sex Offender must notify either the appropriate Police Agency or the New York State Department of Criminal Justice Services whenever he changes his place of residence. He must do this in writing ten days before he moves. VanBergen sent a form to DCJS advising them that his address would be changing from the NYS Correctional Facility to 72 Henry Street, Binghamton, New York. DCJS consequently notified the Binghamton Police Department of that information.

Shortly after VanBergen’s discharge, it was learned that he had given a fictitious address to DCJS. The address of 72 Henry Street is in actuality, a vacant lot. The subsequent investigation by Binghamton Police revealed that VanBergen had been in the Pine Street area in previous days, and that he was telling people that he was living at 107 Henry Street. A check of that address revealed that once again, VanBergen was giving false information, as there is no 107 Henry Street.

Efforts to locate VanBergen were unsuccessful, and so on June 2, 2004, City Court Judge John T. Hillis issued a Warrant of Arrest for VanBergen, charging him with Failure to Comply with the NYS Sex Offender Registration Act. VanBergen has never been arrested on that Warrant and remains at large at this time.

Scott W. VanBergen is described as a white male, 42 years of age, born May 20, 2004, 5’10", 185 pounds. His last known address, before the NYS Corrections address was 106 Henry Street.

Binghamton Crime Stoppers is offering a reward of up to $1000.00 for information which leads to the arrest and indictment of the individual(s) responsible for these crimes.
